App and portal terms and conditions

Queensland Teachers' Union Health Fund Limited ABN 38 085 150 376, trading as TUH provides the  Union Health app and Member Portal for use by private health insurance members who are covered by a Union Health product and whose premiums are paid up to date (‘you/your’).  The Union Health websites are designed for use by Australian residents only. The products and services offered by Union Health are not directed at anyone outside of Australia. Your registration to, and use of, these services is considered acceptance of these terms and conditions, as amended from time to time. 

Managing your membership

We will assume that all changes made via the portal or app are made by the member in whose name the membership is held, or with their authorisation. This person is responsible for all activities that occur under the membership. Changes to your contact details made via the portal or app will take effect immediately. Other membership adjustments require processing time. 
If you think you have made a mistake, please contact us as soon as possible.

Claims

Claims made via the services will be paid in accordance with legislation and the Union Health Fund Rules.  Members will be required to reimburse Union Health for any claims found to be in breach of the Fund Rules.
Daily limits may apply to the value of claims that can be submitted via the services.
If a claim submitted by you is selected for audit, you agree to co-operate fully in this process.
You should retain the original invoice/receipt relating to your claims for at least 12 months. You will not be able to access the file or image following upload to the app.
Union Health does not guarantee that claims for all health services will be available for processing via the services, or that processing or payment of your claim will occur within a certain time period.
Claim history and benefit usage information do not take into account any unprocessed or pending claims and may not be available for all service types.
All results of the benefit calculator are subject to the accuracy of the information you provide and are indicative approximations only.  Benefit quotes are based on your level of cover at the date of generation, benefit payments may differ if your cover changes on or before the date of the health service.

General features

Location based services

Some features of the app such as the preferred provider search, rely on device-based location services. Use of these features requires that we collect, use, transmit and process your location data. By enabling location services, you consent to this occurring. You can disable location services via your device and app settings, however doing so will disable your ability to use this feature of the app.

Security

Union Health will take all reasonable steps to protect the information you provide us via the services. There are risks in using internet-based services and we cannot guarantee against these, therefore you accept that use of these services is at your own risk.
Our app and portal provide secure account registration and access options which may include security credentials such as passwords, biometric recognition and pin codes. There can only be one password per membership.
You may share access details with another person on your membership, however Union Health accepts no responsibility for transactions processed by another person. It is your responsibility to update your access details if a previously authorised person leaves your membership. We will assume that any access to the services using your security credentials is authorised by you.

To prevent unauthorised access, we strongly recommend you: 

  • Keep your password secure and protected 

  • Keep only one record of your password and keep this separate from your member card

  • Do not tell any unauthorised person your password

  • Log out as soon as you have finished using the service

Please immediately notify Union Health of any unauthorised use of your membership online or any other breach of security.   

Privacy

Information collected via the services will be managed in accordance with the Union Health Privacy Policy. 
The personal information including claims history of all members on the policy is available to anyone accessing the membership via the member portal or app.  
In submitting a claim via the services, you agree that Union Health may disclose your personal information to the nominated health service provider and you authorise this provider to release information in relation to the claim to Union Health.
In using the services, you agree that Union Health has the right to monitor any information submitted by you, including tracking your activity in the service.

General terms and conditions

Appropriate use

To use our app, you will need to download the app to your device and ensure that you regularly download and install all relevant updates.
You agree not to:

  • copy, transmit, licence, reverse engineer, adapt, or reproduce the whole or any part of the services;

  • use the services in any way that could bring Union Health into disrepute including using the services for any unlawful purpose; and

  • use the services in any way that could impair, overburden, disable or compromise the services.

Where use the services in breach of these terms and conditions is detected, Union Health may remove your access to these services.  Your access to the portal and app will also be disabled in your membership is terminated or suspended.

Communications

The Union Health app has push notification functionality meaning that Union Health can send push notifications in the form of service announcements and marketing messages.  
There is an option within the settings menu of the app that allows the app user to switch this functionality on or off.  If the functionality is switched off within the app, only important service announcements will be sent to you via a push notification.
Union Health may otherwise communicate with services users via SMS, email or post. 

Analytics

In accordance with our Privacy Policy, when you access the services, we capture and log information about your activity in the service.  We may also use Google Analytics or similar tools, and generate aggregated de-identified reporting. We use this information to understand how users are interacting with the services and identify opportunities for improvement.

Intellectual property

All intellectual property rights in the Union Health services are owned by or licensed by Union Health. Union Health grants you a non-exclusive, non-transferrable, revocable licence to download the app or use the website or portal in accordance with these terms and conditions.

Disclaimers

Union Health is not liable for errors or omissions to the service and does not guarantee that it will be available to users at all times.
To the extent permit by law, Union Health will not be liable for any damage, claim, liabilities, expenses or loss, whether direct or consequential, to any person as a result of use of the services (whether authorised or not).
Union Health may terminate the services or alter functionality, at any time.
The services may link to external third-party websites including but not limited to Google Maps, NAB and CareMonitor. We make no representation as to the accuracy of, and accept no liability for, the content sourced from, or use of, linked external websites. Use of external websites is subject to the terms and conditions and privacy policies of those sites.

Minimum Terms Required by Apple

  1. If you have obtained the app via Apple's App Store, you acknowledge and agree that:

  2. these terms and conditions are between you and Union Health, not Apple;

  3. Union Health, and not Apple, is solely responsible for the app;

  4. Your use of the app is subject to Apple's Usage Rules set out Apple Media Services Terms and Conditions;

  5. Apple has no responsibility whatsoever to provide any maintenance or support services for the app;

  6. To the extent permissible by law, Apple makes no warranties and accepts to liability regarding the app;

  7. Apple is not responsible for any claims that you have arising out of your use of the app;

  8. When using the app, you will comply with any applicable third-party agreements, for example your wireless data service agreement;

  9. Apple will have no responsibility whatsoever for the investigation, defence, settlement or discharge of any third-party claim that the app infringes that third party’s intellectual property rights; 

  10. Apple and its subsidiaries are third party beneficiaries of these Terms of Use and, upon your acceptance of these terms and conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary; and

  11. You warrant that you are not located in a country that is subject to a U.S Government embargo, or that has been designated as a ‘terrorist supporting’ country and you are not listed on any U.S Government list of prohibited or restricted parties.

If you download the app through the Apple App Store and/or the Google Play Store Market, in addition to the terms set out in these Terms and Conditions, your use of the app is also subject to Apple's End User License Agreement available on the Apple website or Google Play's Terms of Service.

These Terms and Conditions are governed by the laws of Queensland. You submit to the jurisdiction of the courts of that State and all courts with jurisdiction to hear appeals from those courts in respect of any proceedings in connection with these Terms and Conditions.
